Certified Court Judgement Validates Our Position – Rivers AG

Rivers State Attorney-General and Commissioner for Justice, Dagogo Israel Iboroma, SAN, has said the certified true copy of the Court judgment has affirmed and validated his position yesterday.

Iboroma while addressing newsmen on Tuesday in Port Harcourt maintained that it is obvious from the document that there was an intended mischief by the misrepresentation of the judgment of the High Court of Rivers State in Suit No: DHC/20/CS/2024 in the social, print and electronic media yesterday.

The Attorney-General noted that a Court Order embodies the enforceable decisions of a judgment.

“In this, the enforceable orders of the Court are, that this suit be and is hereby dismissed/struck out for want of jurisdiction; that the Peoples Democratic Party (PDP) be and is hereby joined as 4th defendant; that the claimants’ case be and is hereby dismissed for lacking in merit.”

He said contrary to the false claim and misrepresentation in social, print and electronic media, the Court did not make a declaration that Martin Amaewhule is the Speaker of the Rivers State House of Assembly neither did it make a declaration that Martin Amaewhule and 26 others are members of the Rivers State House of Assembly and the Peoples Democratic Party (PDP), arguing that if it were so, it would have been embodied in the order which was obtained from the Court and circulated for the purpose of clarity.

“By the deliberate misrepresentation yesterday, the Honourable Court has been painted in bad light and the public misled and misinformed”

“Whatever finding of fact that is not included in the court order is an obiter dictum, which has no binding force,” he concluded

Iboroma further urged the media not to give any interpretation to any judgment without first reading it and seeking legal advise.
