PDP Sues Ned Nwoko, Seeks By-Election for Delta North Senatorial Seat

The Peoples Democratic Party (PDP) has filed a lawsuit at the Federal High Court in Abuja, seeking to declare the Delta North Senatorial seat vacant following the defection of Senator Ned Munir Nwoko to the All Progressives Congress (APC).

In Suit No: FHC/ABJ/CS/454/2025, filed by its counsel, Dr. Ayo Asala (SAN), the PDP is requesting the court to order the Independent National Electoral Commission (INEC) to conduct a by-election to fill the seat.

The suit names Senator Nwoko as the first defendant, with the Senate President and INEC listed as the second and third defendants, respectively.

The PDP is also demanding that Nwoko return all salaries, allowances, and benefits he received as a senator from the date of his defection. The party argues that, based on Section 68(1)(g) of the 1999 Constitution (as amended), an elected lawmaker who defects to another party should vacate their seat.

The party further seeks a court order compelling the Senate President and INEC to declare the seat vacant and conduct a fresh election.
