Appeal Court upholds Umahi’s candidacy for the APC in Ebonyi South.
Ibekimi Oriamaja Reports
A Court of Appeal in Abuja has confirmed Governor David Umahi as the All Progressives Congress (APC) senatorial candidate for Ebonyi South. Ann Agom-Eze had challenged Umahi’s election as the APC senatorial candidate.
On July 22, a federal high court in Abakaliki dismissed Umahi’s suit, in which he sought recognition as the APC candidate for the senatorial district. The court then ordered a new primary election to be held within 14 days. On July 31, the APC held a new primary election, and Umahi was declared the winner.
The appeal court ruled in the governor’s appeal that the high court was incorrect in upholding Agom-counter-affidavit. Eze’s The appellate court also ruled that the trial court erred by failing to uphold the June 9 primary election in which Umahi was nominated as the APC senatorial candidate.
The court claimed that no one challenged the nomination within 14 days, as required by Section 285(9) of the 1999 constitution. Govenor Umahi expressed gratitude to God for the judgment in a statement issued by his Media Aide, Chooks Oko. “With this decision, the Court has once again asserted its inviolate position as the hope of all those seeking justice,” he said.
